Products & Design

Products made by Couture Cakes are made by hand and accordingly there will be variations in appearance from the design image. All illustrations/design images provided and descriptions displayed on our Website or distributed by email, brochure or in any other way are for guidance purposes only and will not form part of the Contract. Couture Cakes does not guarantee to match up the exact colours and designs you have chosen due to the fact that every product is handmade by us in our kitchens and may vary despite every effort being made. We also cannot guarantee that all the product-lines used in the construction of the platters/desserts/cake/cupcake or cookie will be available at the time of making. For example, when a supplier de-list an item such as a particular ribbon colour design, or food colouring, we will endeavor to re-design a cake, cupcake or cookie to reflect as closely as possible the spirit of the original design using replacement products. In all cases we will try to contact you to advise you of any such changes, however www.wightfoods.co.uk Couture Cakes reserves the right to replace these items with component parts of equal or better quality without consultation. We reserve the right to make alterations to the design, appearance and technical specifications of our products from time to time and at such time or at any other times, to make alterations to our advertised information concerning such Goods, without notice. Once the cake is cut and served, this will signify your acceptance that the cake was fit for purpose, and no compensation or refunds will be given.

Deposits & Payments 

Please note, that if full / balance payment of the order is not received 6 weeks prior to the delivery (without customer contacting us to make arrangements), collection and/or set-up date, it is assumed that the order has been cancelled. The cancellation policy, therefore, applies in all cases. If after the 6 week deadline you try to make a payment, we reserve the right to refuse your trade in all cases with full loss of your deposit. Cake orders which are cancelled at short notice (within 10 weeks of the event date) will still be charged for in full, as we are rarely able to rebook dates at such short notice.

Please note that all deposits are NON-REFUNDABLE and NON-TRANSFERABLE. All deposits become due once you have placed, checked and confirmed the details of your order. Couture Cakes will not treat your order as accepted until your deposit has been received.

No orders will be confirmed unless a non-refundable Deposit is paid as agreed. Orders placed within 2 weeks of the delivery date has to be paid in full before the order will be confirmed. The Balance is due 44 days before Delivery takes place Full Balance amount to be settled at least 6 weeks before delivery / collection of Wedding Cakes. 

We will always try to accept your order, however we strongly encourage early ordering. Since we custom make each and every item, we operate on a first come, first served basis and sometimes experience full capacity during peak seasonal periods. Cakes can require a minimum of one month and up to six months to produce, depending upon the complexity of the flowers etc which is handcrafted for you. Please Enquire regarding orders on short Notice, and we will try to accomodate you.

In the event that any payment is subsequently declined, your order will not be completed or released until alternative arrangements have been agreed and payment is made in full. The customer will be responsible for the payment of any additional charges incurred as a result of the payment failure.

Couture Cakes and www.wightfoods.co.uk accepts no responsibility for any loss whatsoever caused for non-delivery under these circumstances.

Complaints

You must notify us within 48 hours of wedding / celebration cake delivery of any complaints, with appropriate photos or evidence, if required. You need to notify us in writing by email, and we will consider your remarks with discretion, and may or may not decide to offer a partial refund, based upon the individual circumstances of the complaint. Once the cake is cut and served, this will signify your acceptance that the cake was fit for purpose, and no compensation or refunds will be given under normal circumstances, but we can make exceptions if we deem fit, as goodwill.

We genuinely care about every platter of savoury food or cake or dessert and work hard to try and ensure your expectations are met. You are required to give me the opportunity to make any corrections or repairs and must notify me of the problem within one hour of accepting the food order or cake. If there is a complaint about the taste or quality of the food / cake, I will require a good sized portion of the cake within 24hours of delivery/collection. A decision will then be made on the basis of the returned item for investigation. No refund or compensation will be offered if no cake is returned for investigation. Taste is subjective and we don't take back cakes just because you don't like the taste or offer refunds for that matter due to personal taste.

We will not be liable for any loss (including loss of profit), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods (even if caused by our negligence), nor will any delay entitle you to terminate or rescind the Contract. 

PRIVATE CHEF SERVICES

Private Dining events include your private chef hire, all food & ingredients, and chef preparing your meals on site and serving it to your table. Plates will be cleard from your table and washing up will be done afterwards along with cleaning up kitchen and areas used. Chef will set your table before service commences. Waiting staff can arranged prior to booking if needed.  Chef WILL NOT be responsible for serving your drinks during or after meals, but waiting staff can be arranged if you wish to have this service included.  If chef is providing crockery / cutlery (Usually a HIRE Charge for this), there will be a cut off time when service ends and all items need to be collected in for cleaning and removing from premises. We will discuss this during a PRE-Event Site Meeting. 

Allergies

It is your responsibility to advise us of any known allergies to any ingredients that may be used in the Private chef menu's / platters/ desserts / cakes or cookies.

Please be aware that whilst your chosen product may not be made with nuts or a nut product, it will be prepared in a kitchen where nut products may be used in other cakes and fillings. I cannot guarantee that your cake or cookie will be free from all nut traces.

Items Made without Gluten and/or dairy foods. The products are made in a kitchen where gluten and dairy are used. We have stringent cross contamination polices in place. We however cannot guarantee that the product will be free from all traces of gluten or dairy. Therefore the cakes and cookies may not be suitable for a customer with serious allergies or someone prone to anaphylactic reactions.

Changes to your order

Your cake / dessert / food platters order is very important to us so please take the time to check the details of your order carefully. It is your responsibility to notify us of any changes required to your original order. We will accommodate any changes where possible but cannot guarantee to do so and reserve the right to increase the price quoted for any extra work required. Please note we are unable to make any changes within 21 days of the delivery/collection date for celebration cakes / food delivery orders or within three weeks of the event / wedding date. 

If you wish to cancel your order, this must be done in writing as soon as possible. Please note that all monies paid are non-refundable and non-transferable in the event of cancellation.

If, due to unforeseen circumstances, it is necessary to change the date of the event / wedding we will do our best to accommodate your order but cannot guarantee to be able to do so. Please bear this in mind when ordering, as any monies paid are non-refundable and non-transferable.

Personal Messages

You must agree that any messages posted by you on your card or sent by us on your behalf to a third party will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment or distress to any person or are otherwise unlawful or objectionable. You are entirely responsible for any text or other material which you post or send on this message system and we accept no liability for any such content.

Collecting your order

All orders may be collected free of charge from us in Newport, IOW by prior arrangement. A collection time slot will need to be agreed to. In the event of you being over 1 hour later than the time slot agreed on to collect any products, www.wightfoods.co.uk / Couture Cakes cannot guarantee they will be available to collect. www.wightfoods.co.uk / Couture Cakes accepts no responsibility for any loss howsoever caused for non-delivery under these circumstances, and no refund will be available. We will however do our very best to accommodate particularly due to unforeseen circumstances but we cannot guarantee we will be able to change the collection time unless previously agreed. We strongly recommend that you call us as soon as possible if you are running late to give us the best chance of being able to accommodate a later collection. A signature is required on collection confirming that you have received your order in good condition and as specified.

www.wightfoods.co.uk / Couture Cakes is unable to accept any liability for any damage sustained to the ordered goods once it has been collected and signed for.

Delivery

Delivery and handling charges may apply to your Order. FREE Delivery may apply to certain orders in close proximately to our base, so please enquire.

All delivery times and dates are subject to availability but we will do our best to accommodate your requirements. Delivery should be requested at the time of ordering or as soon as possible afterwards.

For orders delivered and set up at the venue, there may be a fee of £20 to £85 depending on where delivery must take place, as a ferry crossing may be needed. 

It is your responsibility to ensure that you have provided correct delivery information, including the name, address and postcode. We will not be responsible for orders which are not delivered due to incorrect of incomplete information being supplied by you. Deliveries to hospitals, military bases and business addresses will be delivered to a main reception or mailing room prior to internal distribution. Deliveries cannot be made to PO Box addresses. All deliveries made to hospitals must include the ward name or number in the relevant address field. It is your responsibility to ensure that someone will be available to accept your order. A signature will be required on delivery to confirm receipt. It shall be your duty to examine the Goods upon delivery to ensure that the delivery is complete and that the Goods have not been damaged in transit. We shall not be liable whatsoever if you fail to give such notice of damage or non-delivery and any such damage to the goods shall be deemed to have occurred after transit or delivery, unless the contrary is proven by you.

If there is no-one available to receive the cake at the agreed delivery time, your order will be returned to www.wightfoods.co.uk / Couture Cakes and we will contact you to arrange an alternative delivery or collection time for which a charge will be payable. www.wightfoods.co.uk / Couture Cakes accepts no responsibility for any loss or consequential loss incurred by the customer as a result e.g. a wedding without a wedding cake. 

Whilst www.wightfoods.co.uk / Couture Cakes will try to ensure that your order is presented at its very best we cannot be held responsible for the location of the food stuffs at the venue, the stability or levelness of the table upon which the cake is displayed or the quality of the surrounding around the cake. Please ensure, therefore, that the 'cake presentation table' is level, stable and strong enough to hold the cake. A large six tier rich fruit wedding cake can weigh around 20Kg. Please also remember that chocolate covered cakes can melt under extreme conditions as are found within a marquee.

On delivery we will make the recipient aware of any non-edible items included within the cake that must be removed before the cake is cut and served. We will provide a form for the person taking delivery to sign to confirm that I have advised them of these matters. It is your sole responsibility to ensure that all inedible items are removed from the cake prior to serving and we cannot accept any liability in that respect.

If your cake is to be set up by staff at the venue we will explain how the cake is to be displayed and obtain a signature to verify that I have done so. If we are to set up the cake at the reception venue we will take photographs of the cake before leaving.

Once the cake has been delivered and signed for www.wightfoods.co.uk / Couture Cakes is unable to accept any liability for any damage sustained to the cake or food ordered thereafter nor for any failure to follow the instructions provided.

IMPORTANT NOTICE: CLIENTS SHOULD HAVE SUITABLE INSURANCE IN PLACE FOR THEIR EVENTS

Force Majeure

Neither we, nor any courier or postal service that we use shall be liable for any failure to deliver or perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, disease, epidemic or from any industrial dispute or strike whatsoever. Should the status quo demand a lock-down or curfew situation, where we were unable to make alternate arrangements, and cannot perform the service sold to the client, we cannot be held responsible for the loss or failure to deliver service that may result, as it will be beyond our control.

Cake and Food Storage

Couture Cakes / www.wightfoods.co.uk prides itself on baking homemade cakes /preparing fresh to order foods and desserts so we know exactly what goes in to them. No additives or preservatives. www.wightfoods.co.uk / Couture Cakes are therefore unable to make a warranty as to the length of time for which the food / cakes will remain fit for consumption. We do however recommend our cakes / desserts / food are best eaten on the day they are collected or delivered but some food and desserts will last a few days if you store them properly and refridgerate. If the desserts / food fresh dairy or meat or seafood or other perishable ingredients, it needs to be stored in the refrigerator. HSE recommends any food not ot be out of refridgeration longer than 4 hours. In order to keep a cake that is covered in fondant in a perfect condition it must be stored out of sunlight and at room temperature. Fondant covered cakes should not be refrigerated prior to cutting or serving. For this reason fondant covered cakes will not contain cream cheese frosting. It is the responsibility of the customer to keep the cakes and food in the manner prescribed by us and those rules prescribed for under Health and Safety regulations. 

Equipment Hire

All equipment requires a cash deposit on top of the hire charge. The deposit will be reimbursed in full to the hirer on safe return of the hired equipment provided it has not suffered any damage whatsoever. Damage includes: cuts, chips, scratches, breakages, cracks, rips, tears, dents, bending, staining and discolouration. All hired equipment should be clean and in the original packaging provided. Violation of any signed agreements can result in www.wightfoods.co.uk / Couture Cakes withholding the deposit in part or full. In addition, failure to return the hired equipment within 5 days will carry a penalty of £5 or more per item per day until the entire deposit is lost. All cakes are priced according to our current pricing policies and does NOT include the hire charge

Returns

Because of their perishable nature, cakes, cupcakes and cookies are non-returnable. This does not affect your statutory rights

Publication and Promotional Rights - CAD Design Service for Cakes

By placing your order by means of paying a deposit the client agrees that Couture Cakes is the sole designer and owner of the final CAD cake design. All cake designs used by Couture Cakes remain the property of Couture Cakes. The client has no ownership rights over any cake design. We reserve the right to re-use and publish our photographs of the client's cake as and when required. We do not guarantee exclusivity of cake designs between our clients. 

Design Rights

The ownership of the 'cake design' remains with Couture Cakes and is not transferred on ownership of the product to the client. This is important because it means that Couture Cakes has the right to publish and sell the aforementioned 'cake design' to other clients. During the consultation process the client views a range of existing cake designs from Couture Cakes. The client selects a design, variation of a design or part/combinations of various designs. This is standard practice within the industry. 

Privacy Policy

The privacy of www.wightfoods.co.uk / Couture Cakes clients is very important to us. We will never divulge names of clients and do not share client details with other companies. Your details are kept strictly and confidential, for our use and records only. 

Events outside our control

We cannot be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any act, event, non-happening, omission or accident beyond our reasonable control. 

Entire Agreement

These terms and conditions together with our current website prices, delivery details and contact details set out the whole of our agreement relating to the supply of a cake or other food order to you. Nothing said by any other person on our behalf should be taken as a variation of these terms and conditions or as an authorised representation about the nature or quality of our food and cakes. The Same goes for fraud and fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading. Whilst we agree to use our reasonable endeavours to ensure that www.wightfoods.co.uk / Couture Cakes Website and/or the Services are fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of www.wightfoods.co.uk /  Couture Cakes Website or Services and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of www.wightfoods.co.uk /  Couture Cakes Website and/or the Services impossible or impractical. While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy or completeness of the material on this Website. We may make changes to the material on this Website or to any services or prices described in it, at any time without notice. The material on this Website may be out of date, and we do not make any commitment to update this material.

Invalidity

If any part of these terms and conditions is unenforceable, the enforceability of any other part of these conditions will not be affected.

Our right to vary these Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that you place your order with us unless we notify you of a change to these terms and conditions and you do not reject the changes within 7 days of their notification.

Law and Jurisdiction

These terms and conditions will be governed by English law and any dispute arising from them shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
